By accessing or using LearneyAI (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

LearneyAI is an AI-powered learning platform that allows users to upload study materials, generate interactive games using artificial intelligence, and publish or play those games. The Service includes features such as user accounts, game creation, a public game library, a leaderboard, and a reward system (XP and coins).

You must create an account to access most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when registering.

You must be at least 13 years old to create an account. By registering, you represent that you meet this age requirement.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or harmful activity.

Content you upload.You retain ownership of any study materials, documents, or other content you upload to the Service (“Uploaded Content”). By uploading content, you grant us a limited, non-exclusive licence to process and use that content solely for the purpose of generating games and operating the Service.

Games you create.Games generated by the AI based on your materials (“Generated Games”) are yours. You may publish them publicly or keep them private. By publishing a game publicly, you grant other users a licence to play it.

Your responsibility. You are solely responsible for the content you upload and the games you publish. You must ensure you have the right to use any material you upload (e.g., you own it or have appropriate permission). Do not upload content that infringes third-party intellectual property rights, contains illegal material, or violates these Terms.

You agree not to:

• Upload, create, or distribute content that is unlawful, harmful, defamatory, or obscene.
• Infringe the intellectual property rights of any third party.
• Use the Service to generate spam, phishing content, or malware.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Reverse engineer, decompile, or scrape the Service in a manner that violates applicable law.
• Abuse the AI generation system (e.g., sending harmful prompts or attempting prompt injection).
• Engage in any activity that disrupts or interferes with the Service.

Games are generated by third-party AI models. The output may occasionally be inaccurate, incomplete, or unsuitable. You are responsible for reviewing generated games before publishing them. We do not guarantee the accuracy, quality, or educational value of any AI-generated content.

You acknowledge that AI models are trained on broad datasets and that similar outputs may be generated for other users with similar inputs.

All trademarks, logos, and service marks displayed on LearneyAI are our property or the property of their respective owners. Nothing in these Terms grants you any licence to use them without prior written permission.

The platform's software, design, and underlying code are protected by copyright and other intellectual property laws. You may not copy, modify, or distribute them without our express written consent.

XP, coins, and levels are virtual rewards with no monetary value. They cannot be redeemed for cash, transferred between accounts, or exchanged for real goods or services. We reserve the right to modify or discontinue the rewards system at any time without compensation.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by applicable law, LearneyAI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including loss of data, loss of revenue, or loss of goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

You may stop using the Service at any time. You may request deletion of your account by contacting us.

We may suspend or terminate your access to the Service at our discretion, with or without notice, if you violate these Terms or if we decide to discontinue the Service.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation where possible.
